Nigeria Expatriate Quota: Who Applies, Process and Timelines

The expatriate quota is the company-level approval needed before any foreign employee can work in Nigeria, now limited to roles Nigerians cannot fill.

An expatriate quota (EQ) is a permission from Nigeria’s Federal Ministry of Interior that lets a company employ a set number of foreign staff in named positions. Every foreign employee must fill an approved quota slot before they can get an STR visa and a CERPAC. The company applies, not the individual, through the Ministry’s eCitiBiz portal. Since the 2025 reforms, quotas are approved only for roles Nigerians cannot fill, and each slot needs at least two Nigerian understudies.

For Chinese companies, the quota decides how many people you can bring, in which roles and for how long, so it is one of the most important approvals you will hold.

Expatriate quota: the process

  1. Register with CAC, import capital
  2. Obtain business permit
  3. Apply for quota on eCitiBiz
  4. Ministry inspection and approval
  5. Staff get STR visa and CERPAC
  6. File monthly expatriate returns

Key points

  • Applicant: a company or organisation registered in Nigeria (foreign-owned, joint venture or local), approved by the Ministry of Interior.
  • Prerequisite: foreign-owned companies normally need a Business Permit first, which requires at least ₦100 million in issued or paid-up share capital.
  • Role test: specialist roles Nigerians cannot fill. Expatriates need a degree, HND or specialist certificate plus relevant experience.
  • Understudies: at least two Nigerian understudies with a degree or HND per expatriate post.
  • Validity: typically 7 years in total (3 years, then two 2-year renewals); oil and gas 4 years. The 2025 reforms describe slots as lasting 4–7 years depending on sector.
  • Monthly returns: quota holders file monthly expatriate returns online with the NIN of every expatriate and understudy.

Where the quota fits

Hiring a Chinese employee legally in Nigeria involves four gates: company registration (CAC), business permit, expatriate quota, and then the individual’s STR visa and CERPAC. The quota is the third gate. It approves positions, not people: for example “one project manager, two electromechanical engineers”. The company then places named staff into those positions. For the individual steps, see our STR visa and CERPAC guide.

Who can apply

Published summaries of the Ministry’s quota handbook say applicants can be wholly foreign-owned companies, joint ventures and local companies, registered as limited companies, LLPs, business names, limited partnerships, companies limited by guarantee or incorporated trustees.

Companies with foreign shareholding usually need a Ministry of Interior Business Permit first. The 2022 Handbook on Expatriate Quota Administration sets minimum issued or paid-up share capital of ₦100 million for a business permit. The Corporate Affairs Commission’s own position has shifted over time; see our company registration guide for details.

What changed in 2025

In April 2025 the Ministry announced reforms that tightened quota and business permit reviews:

  • Only roles Nigerians cannot fill. Administrative, sales and general trade roles are hard to justify.
  • Two understudies with a degree or HND for each expatriate post, to show skills transfer.
  • Linked databases. The Expatriate Administration System (EAS) connects immigration, employment and tax data to spot quota misuse and missing understudies.
  • Higher fees. Business permit and quota fees are set to rise; new amounts had not been announced.
  • Repatriation insurance of US$500–1,000 a year per expatriate is planned.

How to apply

  1. Register the company with the CAC, get a tax ID, and bring in capital through a bank to obtain an eCCI.
  2. Obtain a business permit from the Ministry, with directors’ passport pages, an authorised representative’s contacts, bank references and statements.
  3. Prepare the quota request on company letterhead, listing each position with title, qualifications and proposed salary, plus a training plan for Nigerian staff.
  4. Submit online through eCitiBiz (ecitibiz.interior.gov.ng), which issues a file number and tracking code.
  5. Company inspection. The Ministry may inspect your premises. New slots and renewals carry an inspection fee (₦45,000–₦150,000 in 2022, depending on travel).
  6. Use the approval. Staff apply for STR visas abroad with the approval, then get a CERPAC after arrival.
  7. Stay compliant. File monthly returns and renew or redesignate positions on time.

Documents

  • Certificate of incorporation, MEMART, business plan or company profile
  • CAC forms or e-status report; joint venture agreement if relevant
  • Current tax clearance certificate and proof of premises
  • Proof of capital importation or other funding, and equipment import records
  • Sector licences where applicable; contract evidence for construction firms
  • Training programme for Nigerians with proposed salaries
  • Job description for each quota position: title, qualifications, salary

Validity, renewals and fees

Item Detail Source
Standard validity 7 years total: 3 years, then two 2-year renewals Mondaq (citing Ministry handbook)
Oil and gas 4 years total: 2 years plus one 2-year renewal Mondaq (citing Ministry handbook)
2025 reform wording Slots typically 4–7 years by sector KPMG, PwC
Company inspection fee ₦45,000–₦150,000 (2022) KPMG 2022
Fee per slot (reference) About ₦500,000 plus a floating processing fee; one slot covers one expatriate for 2 years MOFCOM 2025 country guide

The old “Permanent Until Reviewed” (PUR) slots were put under review in 2022, and PUR positions not submitted for appraisal were treated as lapsed. Since fees are due to rise, treat the figures above as reference only and check the latest Ministry notice.

Monthly returns

Quota holders must file Expatriate Monthly Returns on eCitiBiz, listing the National Identification Number (NIN) of each expatriate and each Nigerian understudy. These returns are how the Ministry checks whether slots are really used and understudies are in place. Missed returns can block renewals and, in serious cases, lead to withdrawal of the quota. Give one HR person responsibility for returns and CERPAC expiry dates together.

Advice for Chinese companies

  • Ask only for real specialist roles and describe the technical requirements clearly.
  • Make understudies real. Qualifications, NINs and training records are checked; paper-only understudies are a serious risk.
  • Start early. The Ministry publishes no official processing time. Mondaq’s 2026 investor guide gives about 3–7 weeks for the business permit and quota together, and it is often longer, so start as soon as a contract is won.
  • Use other routes for short stays. Installation crews staying weeks or months can use a Temporary Work Permit (US$600 for three months, US$1,100 for six), and visitors use the e-Visa.
  • Keep payroll tax aligned with Nigerian rules; see the Nigeria Tax Act 2026 guide.
  • Free zone companies can benefit from quota waivers; see our free trade zones guide.
